Welcome to AnyDress.ai (“Company,” “we,” “us,” or “our“). We are registered and based in the Republic of Cyprus.
These Terms of Service (“Terms“) govern the B2B relationship between AnyDress.ai and the business entity or individual (“Client,” “Merchant,” “you,” or “your“) installing our WordPress plugin and utilizing our Application Programming Interface (API) for Virtual Try-On services (collectively, the “Service“).
By registering an account, installing the AnyDress.ai plugin, or accessing our API, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Description of Service
AnyDress.ai provides a SaaS platform accessible via a WordPress/WooCommerce plugin. The Service includes two primary tools: (1) Virtual Try-On, which allows your website visitors (“End-Users”) to upload photos of themselves to visualize clothing items, and (2) Virtual Photoshoot, which allows you (the Merchant) to upload model and garment images to generate professional product catalog photos.
2. Account Registration & Eligibility
2.1. Merchant Age Requirement: To enter into this B2B agreement, you (the Merchant) must be at least 18 years of age or the age of legal majority in your jurisdiction.
2.2. Account Security: You are responsible for maintaining the confidentiality of your API keys and account credentials. You are strictly liable for all activities that occur under your account.
3. End-User Data & Age Policy
As a B2B service provider, AnyDress.ai acts solely as a Data Processor. You (the Merchant) act as the Data Controller.
3.1. Shopper Age Policy: AnyDress.ai does not restrict the Virtual Try-On service to adults, as it may be used to visualize children’s clothing. However, you (the Merchant) assume full responsibility for ensuring that if any End-User images processed through the Service belong to a minor, you have obtained explicit, legally valid consent directly from the minor’s parent or legal guardian prior to processing.
3.2. Merchant Obligations: You represent and warrant that you have the legal right to collect, process, and transfer all End-User data (including face and body images) to AnyDress.ai, and that your own website’s Privacy Policy accurately reflects this data transfer.
3.3. Merchant Responsibility for Privacy Disclosures & Consent: As a merchant utilizing the AnyDress.ai Virtual Try-On plugin, you are legally required to inform your end-users about how their image data is collected, processed, and temporarily stored. To assist you with compliance, the AnyDress.ai plugin automatically provides a pre-written “Virtual Try-On Feature Privacy Policy” disclosure.
You can locate this required text within your WordPress Dashboard by navigating to Settings > Privacy > Policy Guide (under the “AnyDress.ai Virtual Try-On” section).
You are required to copy and paste this text into your store’s active, publicly accessible Privacy Policy page. By using our service, you agree that you are solely responsible for obtaining explicit, informed consent from your end-users before they use the Virtual Try-On feature.
3.4. Indemnification & Limitation of Liability: If you, the merchant, fail to include this required privacy disclosure on your website or fail to obtain proper user consent, AnyDress.ai shall not be held liable for any resulting privacy violations, legal claims, damages, or regulatory fines. You agree to fully indemnify and hold AnyDress.ai harmless against any and all claims, demands, or legal actions resulting from your failure to adequately inform your end-users.
4. Acceptable Use Policy
4.1. You agree not to use the Service (or allow your End-Users to use the Service) to:
- Process or generate Not Safe For Work (NSFW), sexually explicit, nude, or pornographic content.
- Process images of individuals without their consent.
- Violate any local, national, or international laws, including privacy regulations (such as GDPR).
- Attempt to reverse-engineer, decompile, abuse, or overload our API.
4.2. When using the Virtual Photoshoot tool within your WordPress dashboard, you are strictly prohibited from uploading images of individuals, models, celebrities, or influencers without their explicit legal consent, or garments that infringe upon third-party intellectual property. By uploading any image (whether a model or a garment) to our API, you represent and warrant that you hold all necessary licenses, copyrights, trademarks, and personality rights to use those images and the items depicted in them. You are strictly prohibited from using this service to generate or promote counterfeit goods. You agree to fully indemnify, defend, and hold AnyDress.ai harmless from any legal claims, lawsuits, or damages arising from your unauthorized use of third-party images, intellectual property infringement, or attempts to generate prohibited (NSFW/illegal) content.
4.3. Plugin Modification & Tampering: You are strictly prohibited from modifying, adapting, altering, reverse-engineering, or decompiling the AnyDress WordPress plugin code, Javascript, or API integrations. Any attempt to tamper with the plugin—including but not limited to bypassing credit/billing mechanisms, disabling safety/NSFW filters, hiding or removing mandatory legal consent checkboxes, or otherwise abusing the Service—is a material breach of these Terms. Such actions will result in the immediate and permanent termination of your license and account, without notice and without refund.
4.4. Plugin Permissions: To facilitate the Virtual Photoshoot feature, the AnyDress plugin requires standard read/write permissions to your WordPress installation. This includes the ability to fetch WooCommerce product images and save generated images directly to your WordPress Media Library and product galleries. We are not liable for any database conflicts, storage limits, or plugin incompatibilities on your local server.
5. Payments, Subscriptions, and Credits
5.1. Subscription Plans: The Service is offered on monthly or annual subscription plans. By subscribing, you authorize our third-party payment processor (Stripe) to charge your payment method on a recurring basis.
5.2. Credits: Subscriptions come with a set allotment of API generation limits. If you exceed your monthly subscription limit, you may purchase additional ad-hoc generation credits via your dashboard.
5.3. Subjective Satisfaction: We do not issue refunds or credit reinstatements based on subjective dissatisfaction with the aesthetic quality, fit, or realism of the generated Virtual Try-On or Virtual Photoshoot images. By using the Service, you acknowledge and agree that AI-generated imagery is provided “as is” and sales are non-refundable.
5.4. Account Registration and Domain Locking: Upon generating an API License Key, your key will be permanently locked to the first website domain that authenticates it. This is a security measure to prevent unauthorized sharing of licenses. You may not transfer your License Key to a different domain.
5.5 Subscription Plans and Base Credits: AnyDress.ai operates on a subscription model (Monthly or Yearly). Each billing cycle, your account is allotted a specific number of “Base Credits” determined by your active plan tier. Base credits reset to zero at the beginning of each new billing cycle. Unused base credits do not roll over to the next billing cycle. If you cancel your monthly or annual subscription, your access will remain active until the end of your current billing cycle, but no prorated refunds will be issued for unused credits.
5.6. Top-Up Credits (Extra Credits): Users on eligible paid tiers may purchase “Top-Up Credits” at any time. Top-Up credits never expire and will permanently remain in your account as long as your account exists. Our system will automatically deduct from your Top-Up credits only when your monthly Base Credits have been exhausted. Top-Up credits are not available for Free Trial or “Tier 0 (Mini Drop)” users. Purchased top-up credits are non-refundable, non-transferable, and cannot be exchanged for cash.
5.7. Account Deletion: You may permanently delete your AnyDress.ai account and all associated data at any time via the “Delete Account” button located within your WordPress plugin dashboard. Warning: Account deletion is an irreversible action. Initiating account deletion will:
1. Immediately cancel any active subscriptions.
2. Permanently erase your API License Key and all connected data.
3. Permanently void all remaining Base Credits and Top-Up Credits.
No refunds will be provided for any forfeited credits resulting from an account deletion.
6. Data Privacy, AI Training, & Sub-Processors
6.1. No AI Training: AnyDress.ai strictly respects data privacy. We firmly guarantee that no Client-submitted data or End-User images are ever used to train, retrain, or improve our AI models.
6.2. Data Retention: Images transmitted to our API are processed entirely in server memory (RAM) and are immediately and permanently discarded the millisecond the generation process is completed. We do not store, save, or retain your uploaded models, garments, or generated images on our server storage or databases. Note: The local 7-day auto-deletion featured in the WordPress plugin applies to your own server’s database, independent of our SaaS retention policies.
6.3. Sub-Processors: To protect our proprietary infrastructure, the list of third-party sub-processors we use to provide the Service is kept strictly confidential. This list is only available to active B2B Clients upon written request, provided such request is made strictly for the purpose of fulfilling the Client’s data protection compliance obligations (e.g., GDPR). By using the Service, you consent to our use of these sub-processors under strict confidentiality and data protection agreements.
6.4. Data Processing Agreement (DPA): Processing of personal data is further subject to our Data Processing Agreement, which forms an integral part of these Terms.
7. Intellectual Property
7.1. Our IP: AnyDress.ai retains all intellectual property rights, titles, and interests in and to the Service, the WordPress plugin code, our proprietary API infrastructure, and our custom generation workflows/prompts. You acknowledge that the foundational AI models used to process and generate images are provided by third-party partners, who retain their respective intellectual property rights to their underlying AI technology.
7.2. Your IP: You retain all rights to your store content, product images, and customer lists. You grant us a limited, temporary license to process the product images and End-User photos solely for the purpose of providing the Virtual Try-On results to you.
8. Limitation of Liability & Disclaimers
8.1. “As-Is” Service & AI Artifacts: The Service is provided on an “as is” and “as available” basis. While we strive for high uptime and accurate visual generation, we do not warrant that the Service will be entirely error-free, uninterrupted, or perfectly accurate in depicting physical garment fit, color, or texture. By using the Service, you acknowledge the inherent unpredictability of Generative AI technology. The AI may occasionally produce “hallucinations,” unexpected background elements, anatomical anomalies (such as distorted limbs or hands), or fail to adhere strictly to your text prompts and editing instructions. AnyDress.ai is not liable for such unintended visual artifacts or unexpected results, and these occurrences do not constitute a defect in the Service.
8.2. Liability Cap: To the maximum extent permitted by applicable law, AnyDress.ai’s total cumulative liability to you for any claims arising out of these Terms or your use of the Service shall not exceed the total amount you paid to us in the three (3) months immediately preceding the claim.
9. Governing Law & Dispute Resolution
These Terms and any dispute arising from them shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of Cyprus.
