1. Our Role: Controller vs. Processor

To understand how we handle data, it is important to distinguish between our two roles under the General Data Protection Regulation (GDPR):

  • Data Controller: When you (a merchant or website visitor) visit AnyDress.ai, create an account, or pay for a subscription, we act as the Data Controller of your personal data.
  • Data Processor: When your website visitors (“End-Users” or “Shoppers“) use the Virtual Try-On plugin on your website, you are the Data Controller of their images, and we act strictly as your Data Processor.

2. Information We Collect as a Data Controller

When you interact with AnyDress.ai as a merchant or visitor, we collect the following types of information:

  • Account Information: Name, email address, company name, website URL, and password.
  • Billing Information: We use a secure third-party payment processor (Stripe) to handle subscriptions and credit purchases. We do not store your full credit card numbers on our servers. We only retain billing history, subscription status, and receipts for accounting and tax purposes.
  • Technical & Usage Data: IP address, browser type, operating system, referring URLs, and information about your interactions with our website.
  • Automatically Collected Information (Log Data): While we do not store your uploaded images, our servers do maintain temporary, pseudonymized connection logs (such as hashed user IDs, client domain names, and error codes) strictly for the purposes of security, debugging, and accurate credit billing. These logs do not contain visual data.

3. How We Use Your Information (Merchants)

We use the information we collect from you to:

  • Create and manage your AnyDress.ai account and API access.
  • Process your subscription payments and API credit purchases.
  • Provide technical support and respond to your inquiries.
  • Send administrative emails, such as API limit warnings, billing notices, and terms updates.
  • Comply with our legal and tax obligations under Cyprus and EU law.

4. Information We Process on Your Behalf (End-User Data)

When your End-Users use the AnyDress.ai plugin on your store, their image data (face/body photos) and pseudonymized usage hashes are transmitted securely to our API to generate the Virtual Try-On images.

  • No AI Training Guarantee: We strictly guarantee that no End-User images or Merchant-submitted data are ever used to train, retrain, or improve our AI models.
  • Minors: While our Service may process images of children’s clothing, it is the sole responsibility of the Merchant (Data Controller) to ensure they have obtained valid parental consent before processing a minor’s data through our API.

5. Data Sharing and Sub-Processors

We do not sell, rent, or trade your personal data. We only share information in the following circumstances:

  • Payment Processors: Such as Stripe, to facilitate billing.
  • Sub-Processors (Confidential): We use third-party cloud infrastructure and GPU clusters to power our API. To protect our proprietary technology, our list of sub-processors is strictly confidential. This list is only available to active B2B Clients upon written request, provided such request is made strictly for the purpose of fulfilling the Client’s data protection compliance obligations (e.g., GDPR).
  • Legal Compliance: We may disclose your data if required by law, subpoena, or other legal processes in the Republic of Cyprus or the EU.

6. International Data Transfers

AnyDress.ai is based in the Republic of Cyprus (EU). If we transfer your personal data or your End-Users’ data to sub-processors located outside the European Economic Area (EEA), we ensure appropriate safeguards are in place, such as the European Commission’s Standard Contractual Clauses (SCCs), to guarantee GDPR compliance.

7. Data Retention

  • Merchant Data: We retain your account and billing information for as long as your account is active, and subsequently as required to comply with our legal and tax obligations.
  • End-User Image Data: Images transmitted to our API are processed entirely in server memory (RAM) and are immediately and permanently discarded the millisecond the generation process is completed. We do not store, save, or retain your uploaded models, garments, or generated images on our server storage or databases.

8. Your Data Protection Rights (GDPR)

If you are located in the EEA, UK, or Switzerland, you have the following rights regarding your personal data as a Merchant:

  • The right to access, update, or delete the information we have on you.
  • The right of rectification (to correct inaccurate data).
  • The right to object to or restrict our processing of your data.
  • The right to data portability (to receive a copy of your data in a structured, machine-readable format).
  • The right to withdraw consent at any time where we relied on your consent to process your personal information.
